TERMS & CONDITIONS OF SERVICE
1. Definitions
“The Career Experts Ltd” (“TCE”, “we”, “us”, “our”): The supplier of professional career advisory, personal branding, recruitment-adjacent, coaching and consultancy services, including all associated programmes, portals, platforms and white-label offerings operated by TCE.
“Client” (“you”, “your”): Any individual, organisation, employer or third party purchasing, receiving or funding Services.
“Writer”: Any contractor, associate or consultant engaged by TCE. Writers are not employees of TCE.
“Services”: Any agreed services including CV writing, resume writing, LinkedIn profile writing, executive branding, interview coaching, job-search strategy, supporting statements, executive biographies, outplacement services and related advisory support.
“Deliverables”: Any written, verbal, digital or recorded outputs produced under the Services.
“Methodology”: TCE’s proprietary processes, frameworks, templates, structures, sequencing, workflows and delivery model.
2. Contract Formation and Pricing
- A binding contract exists once Services are purchased, confirmed in writing or commenced.
- Prices are valid for 30 days unless stated otherwise.
- Prices apply strictly to the agreed scope only.
- No variation or expansion of scope is valid unless agreed in writing by TCE.
- Time shall not be of the essence unless expressly agreed in writing.
3. Nature of Services and No Outcome Guarantee
- Services are delivered on a best-endeavours advisory basis.
- TCE does not guarantee interviews, offers, promotions, contracts or commercial outcomes.
- Hiring decisions, market conditions and third-party behaviour are outside TCE’s control.
- Services are collaborative and instructional, not execution-only.
4. Project Guarantee and Conditional Continuity
TCE guarantees reasonable continuity of professional support, meaning the assigned Writer and or Director will remain engaged until agreed objectives are achieved, provided that the Client follows the agreed process and professional guidance.
This guarantee is conditional. It ceases to apply where the Client:
- Disregards professional advice
- Substitutes their own methodology
- Repeatedly fails to act on agreed actions
- Attempts to materially alter the service purchased
TCE reserves the right to conclude a project where progress is no longer achievable under the agreed model.
5. Mandatory Process-Led Delivery Model
TCE operates a strict process-based delivery framework. All Clients are required to follow it.
Standard Process Stages
- Exploratory sales call (30–60 minutes)
- Order placement
- Onboarding and booking instructions issued by email
- Client books meetings via Writer diary
- Client accepts calendar invitations
- Initial CV writing meeting (typically 2 hours)
- Independent preparation by Client and Writer
- Live drafting of profile, skills and career highlights
- First draft issued
- Client refinements returned within 7 days unless agreed otherwise
- Final CV completion
- Release of additional documents
- Final presentation meeting (approximately 1 hour)
- Final documents issued by email and copied to Head Office
Failure to follow this process may result in delay, suspension or closure.
6. Client Responsibilities
The Client is responsible for:
- Providing accurate and lawful information
- Reviewing drafts promptly
- Returning refinements within agreed timescales
- Booking meetings they can attend
- Accepting calendar invitations
- Ensuring reminders, notifications and time zones are correct
TCE is not responsible for missed meetings due to client diary or notification failures.
7. Communication Policy
- All official correspondence must occur exclusively via email.
- TCE does not conduct service delivery, project management or meeting coordination via WhatsApp, Viber, SMS or social platforms.
- Communications outside email are non-binding and may be disregarded.
8. Meetings, Attendance and Cost Recovery
Writers are contractors and incur cost for preparation, delivery and follow-up.
Where a Client:
- Fails to attend a booked meeting
- Repeatedly cancels or reschedules
- Demonstrates a pattern of non-attendance
TCE may charge £25 per missed session, capped at £125.
Charges may be recovered by:
- Deduction from remaining order value
- Reduction of included Deliverables
TCE may close projects where non-attendance materially impacts delivery.
9. Payments, Suspension and Credit Control
- Payment terms apply as agreed at point of sale.
- Outstanding balances must be settled within 24 hours of first draft delivery.
- TCE may suspend work immediately for late payment without breach.
- Late payments may incur up to 20% recovery surcharge plus VAT and legal costs.
- Where a third party funds Services, liability automatically reverts to the Client if unpaid.
10. Scope Control and Variations
- Packages are bundled for value; individual components carry internal standalone values.
- No retroactive scope changes are permitted.
- Where a Client attempts to alter the service to their own version, TCE may:
- Charge the balance for the appropriate service
- Reduce Deliverables to recover cost
- Additional process changes are not free.
11. Writer Status and Protection
- Writers are independent contractors.
- Writers are paid only upon completion of defined project stages.
- Clients may not engage Writers privately for unpaid or extended work.
- Writer reassignment is at TCE’s discretion and not grounds for refund.
12. Behaviour, Conduct and Termination Rights
TCE may terminate or suspend Services where a Client:
- Becomes abusive, hostile or combative
- Undermines the collaborative nature of the process
- Impacts Writer wellbeing or delivery quality
- Attempts to bypass or sabotage the process
TCE does not continue engagements that become unreasonably difficult to support.
13. Project Closure and Unresponsiveness
Where a Client becomes unresponsive, TCE may formally close the project by email notice to the Client and Head Office. The project will be deemed complete for payment purposes.
14. Intellectual Property and Usage
- All Methodology remains the exclusive intellectual property of TCE.
- Upon full payment, the Client receives a non-exclusive licence to use final Deliverables.
- Deliverables may not be resold, redistributed, benchmarked or reverse-engineered.
- Deliverables may not be used to train AI systems.
- Brand or affiliation claims are prohibited without written consent.
15. Advice, Reliance and Indemnity
- Deliverables are not legal, financial or regulatory advice.
- Clients remain fully responsible for decisions taken.
- Clients indemnify TCE against third-party claims arising from use of Deliverables.
- Misrepresentation against advice voids protections.
16. Refunds and Early Closure
Where TCE closes a project early:
- A rebate may be considered at TCE’s discretion
- Refunds may be up to 75% of remaining value
- Deductions cover preparation time, meetings, admin and contractor costs
- Refund calculations are confidential and non-disclosable
- Once in dispute, matters transfer exclusively to Head Office
17. Complaints and Chargebacks
- Complaints must be raised promptly to allow remediation.
- Acceptance of remedial work extinguishes refund rights.
- Premature chargebacks constitute bad faith and may result in legal recovery.
- Chargeback administration fees may apply.
18. Data Protection and Records
- TCE complies with UK GDPR and Data Protection legislation.
- Meetings may be recorded for quality and audit unless objected to in writing.
- Emails are deemed received unless bounce-back is received.
- Only the latest emailed version of Deliverables is authoritative.
19. Governing Law
Statutory rights are unaffected, terms are governed by English Law, and exclusive jurisdiction lies with the Courts of England and Wales.
