These Terms & Conditions of Engagement explain the basis on which The Career Experts provides professional career consultancy, career development, career assessment, professional writing, coaching and related services.
By purchasing, booking or proceeding with a service from The Career Experts, the Client agrees to these Terms & Conditions.
1. The Career Experts
The Career Experts™ (“TCE”, “we”, “us” or “our”) provides independent career consultancy and career development services to individuals and organisations.
Services may include Career MOT™, Career Programmes, Career Service™, Career Pit Stop™, CV and resume development, LinkedIn optimisation, executive and NED positioning, executive biographies, contractor positioning, job application support, cover letters, supporting statements, interview preparation, job search strategy, career coaching and other agreed career development services.
The precise scope of each engagement is determined by the service or programme purchased and any subsequent written agreement between TCE and the Client.
2. Formation of an Engagement
An engagement is formed when a Client places an order, makes an agreed payment, accepts a proposal or otherwise instructs TCE to commence work.
The project scope may be recorded through an order confirmation, proposal, invoice, email, meeting summary or other written communication.
Where the scope subsequently changes, the most recent clearly agreed written variation will determine the current delivery position.
3. Professional Advice
TCE provides independent professional career advice and services based upon the information available at the time.
Career decisions remain the responsibility of the Client.
TCE cannot guarantee an interview, job offer, promotion, appointment, board position, contract, salary level, business opportunity or other specific career outcome.
Recruitment decisions and market outcomes are influenced by employers, recruiters, search firms, economic conditions and other factors outside TCE’s control.
4. Client Information & Accuracy
Clients are responsible for supplying complete, accurate and truthful information.
TCE may rely upon information supplied by the Client when preparing documents, assessments, applications, profiles or other work.
Clients must review all final material for factual accuracy before it is submitted, published or supplied to a third party.
TCE will not knowingly include false or materially misleading information within a Client document.
5. Delivery Process
The delivery process will vary according to the particular service or programme purchased.
A project may include initial consultation, assessment, strategic positioning, client preparation, information gathering, document development, review meetings, refinement, application support, LinkedIn development, interview preparation and final implementation advice.
Not every service requires every stage.
TCE may adjust the working process where this improves delivery, provided that the underlying agreed scope remains materially unchanged.
6. Client Responsibilities
Clients are expected to participate reasonably and actively in the project.
This includes supplying requested information, preparing agreed material, reviewing drafts, checking factual accuracy, responding within reasonable timescales and attending scheduled meetings.
Clients are responsible for checking meeting dates, times, time zones and calendar invitations.
Material changes to career objectives, applications, target roles or project requirements should be communicated promptly.
7. Meetings, Rescheduling & Communication
TCE operates a scheduled professional consultancy service.
Where possible, material project decisions and changes should be confirmed in writing so that both parties retain a clear record.
Repeated missed meetings, late attendance, incorrect diary dates, short-notice changes or extensive additional administration may affect project delivery.
Where additional meetings, repeated rescheduling, significant additional administration or material additional work are required outside the agreed scope, TCE may propose a revised scope or additional fee before proceeding.
TCE may also pause delivery where repeated communication or scheduling issues materially prevent the project from progressing efficiently.
8. Project Duration
Fixed-fee services are priced on the basis that a project progresses within a reasonable and continuous delivery period.
Clients are therefore expected to provide information, attend meetings, review work and complete agreed actions within reasonable timescales.
Unless a different timescale has been expressly agreed, a project that remains inactive for more than 90 days because of Client delay, non-response, repeated rescheduling or failure to progress agreed actions may be treated as closed.
TCE will normally make reasonable efforts to contact the Client before closing an inactive project.
Where a Client subsequently wishes to resume a closed project, TCE may require the work to be reactivated, reviewed, rescoped or purchased at the current prevailing rate.
Any material delay caused directly by TCE will not count towards this period.
9. Scope of Work
A fixed fee covers the service and deliverables specifically included within the agreed scope.
It does not create an unlimited, indefinite or open-ended entitlement to further documents, applications, meetings, revisions, advice or associated support.
Additional work requested outside the agreed scope may be separately chargeable.
Where requirements materially change during an engagement, TCE may recommend that the project is rescoped before additional work is undertaken.
A significant change in target role, career direction, document purpose or project brief may constitute new work rather than a revision.
10. Substitution or Reallocation of Services
Where TCE and the Client agree to substitute, exchange or reallocate one service or deliverable for another, the original element will be regarded as replaced by the newly agreed work.
Once that replacement work has been provided, the original service does not remain as an additional unused entitlement unless TCE expressly confirms otherwise in writing.
A Client may therefore not retain a replacement service that has already been delivered and subsequently also claim the original service that it replaced.
This applies equally where programme or package components are reallocated to respond to a Client’s changing priorities.
11. Additional & Out-of-Scope Work
Where TCE provides additional work beyond the purchased or subsequently agreed scope, this does not automatically amend the original agreement or create an ongoing obligation to provide further additional work without charge.
Any discretionary or goodwill work is provided on that basis only.
Previous goodwill, additional support, free work, additional documents, additional meetings, fee concessions or discounts do not establish an entitlement to similar concessions in the future.
12. Fees & Payment
Fees are those stated at the point of purchase or subsequently agreed in writing.
Payment terms may vary according to the service, programme or commercial arrangement.
TCE may suspend or delay delivery where an agreed payment remains outstanding.
Any additional work outside the agreed scope may require payment before that work commences.
Current website prices may change from time to time. A new engagement or reactivated project may therefore be charged at the prevailing price rather than a historic rate.
13. Packages & Component Services
Where a Client purchases a package containing several services, the package represents the combination of services agreed at the time of purchase.
If an element of that package is subsequently substituted, reallocated or exchanged by agreement, the package will be assessed according to the revised delivery actually agreed and supplied.
An original package component does not remain indefinitely available after its value or purpose has been used to provide an agreed replacement service.
14. Cancellations & Refunds
Cancellation and refund requests will be considered in accordance with the nature and stage of the service purchased, work already undertaken and any statutory rights that apply.
Professional consultancy, assessment and bespoke document development frequently involve preparation and work commencing shortly after purchase.
Where a Client asks TCE to begin work, any applicable refund may therefore take account of work already completed or services already supplied, where legally permitted.
Nothing within these Terms limits any statutory rights available to a Client under applicable UK law.
15. Drafts, Revisions & Completion
TCE works collaboratively with Clients to develop accurate and effective final material.
Reasonable revisions that form part of the agreed delivery process are included where appropriate.
A request that materially changes the target, strategy, document purpose or original brief may constitute new work rather than a revision.
Once final documents have been supplied or the agreed service has otherwise been completed, that element of the project is regarded as delivered.
16. Artificial Intelligence & Technology
TCE may use appropriate professional technology and AI-supported tools as part of research, analysis, drafting, comparison, quality assurance or career development processes.
AI does not replace professional judgement or Client verification.
TCE remains responsible for its professional service delivery, while Clients remain responsible for confirming the accuracy of personal, career and employment information incorporated into final documents.
Any personal information processed through third-party technology will be handled in accordance with the TCE Privacy Policy and applicable data protection requirements.
17. Intellectual Property
Unless otherwise agreed, TCE retains ownership of its methodologies, templates, frameworks, processes, assessment structures, training materials and proprietary intellectual property.
This includes TCE methodologies and branded concepts including Career MOT™, Career Service™, Career Pit Stop™ and associated frameworks.
Once the relevant fees have been paid, Clients may use their completed personal career documents for their own professional and career purposes.
TCE proprietary methodologies, templates or training materials must not be commercially reproduced, resold, licensed or distributed without written permission.
18. Confidentiality
TCE treats Client career information and project material as confidential and will not knowingly disclose it except where required to deliver the service, authorised by the Client, required by law or reasonably necessary to protect legitimate legal rights.
Further information about the collection, processing and storage of personal data is contained within our Privacy Policy.
19. Complaints & Dispute Resolution
TCE aims to resolve concerns promptly, professionally and proportionately.
Where a concern or disagreement arises regarding scope, payment, delivery, project administration or a particular service, the Client should first raise the matter directly with TCE by email.
TCE will consider the complete project record, including the original purchase, payments received, agreed variations, substitutions, correspondence, meetings and work delivered.
Individual emails, messages, conversations or statements should not be considered in isolation where the project scope has subsequently changed or where alternative services have been agreed and supplied.
Where a dispute concerns whether a particular service remains outstanding, TCE will consider whether that service was subsequently substituted, exchanged, reallocated or otherwise fulfilled through an agreed alternative.
Where appropriate, TCE may propose corrective work, clarification, project closure, revised scope or another reasonable and proportionate resolution.
Clients should allow TCE a reasonable opportunity to investigate and respond to a concern before commencing a payment dispute or chargeback.
Nothing within this section restricts any statutory rights or legal remedies otherwise available to the Client.
20. Project Records
TCE may maintain reasonable records relating to orders, payments, project scope, correspondence, agreed changes, meetings, substitutions and work delivered.
Such records may be used to establish the history and current status of an engagement where there is uncertainty or disagreement regarding what was ordered, agreed, paid for or supplied.
Project records will be handled in accordance with the TCE Privacy Policy and applicable data protection requirements.
21. Third-Party Platforms
TCE may use third-party services for communication, scheduling, payment processing, video meetings, cloud storage, website operation, document development and technology-assisted service delivery.
TCE is not responsible for interruptions, outages, changes or failures of third-party platforms outside its reasonable control.
22. Limitation of Responsibility
TCE is responsible for providing the professional services agreed with reasonable care and skill.
TCE is not responsible for recruitment decisions, employer actions, third-party systems, changes to recruitment platforms, Client submission errors or career outcomes outside its reasonable control.
Nothing within these Terms excludes or limits liability where it would be unlawful to do so.
23. Changes to These Terms
TCE may update these Terms & Conditions to reflect changes in legislation, technology, professional practice, operating processes or the services offered.
The version applying to a new engagement will normally be the version published or supplied at the point that engagement begins.
Changes made after an engagement begins will not retrospectively remove statutory rights or contractual rights already established.
24. Governing Law
These Terms & Conditions are governed by the laws applicable in England and Wales.
Nothing within these Terms affects mandatory statutory protections available to consumers.
